Pompeo's fate will be announced Jan. 17

Jan. 17, 2013 is set as the date for a decision in the aggravated assault trial of Const. David Pompeo.

The officer appeared in Duncan Provincial Court briefly Tuesday to find out that's when Judge Josiah Wood would render his verdict.

Pompeo's charges stem from an incident near Chemainus in September of 2009 when Bill Gillespie was shot after being pulled over in the car he was driving by Pompeo and partner Const. David Birchett.

The trial concluded Nov. 23. That's when "both parties argued their respective positions,'' said defence lawyer Ravi Hira. Todd Patola is representing the Crown.

The trial began in September with eight days of testimony, ending on Sept. 14.

Hira and Patola argued about the admissibility of expert evidence on Nov. 8.

On Nov. 13, Wood announced his decision to allow the evidence of one expert witness while dismissing the submissions of two other experts as irrelevant to the case.
